Terms of use

The terms that apply to your use of the SectraTEK website.

1. About these Terms

These Terms of Use ("Terms") govern your use of the SectraTEK website at www.sectratek.com (the "Site"). SectraTEK is a Prudential Associates company. The Site is operated by Prudential Associates & Cyber-Investigations Group ("Prudential Associates", "SectraTEK", "we" or "us"), 9200 Corporate Blvd, Suite 200, Rockville, MD 20850, United States.

These Terms cover the public Site only. They do not cover the SectraTEK desktop applications, the My Sectra customer area, or anything you buy from us. Those are governed by the SectraTEK license agreement and by the quote and order documents we issue (Section 6). Our Privacy Policy, Cookie Statement, Data Retention Schedule and Acceptable Use Policy also apply to your use of the Site.

2. Accepting these Terms

You do not need an account to read the Site. By visiting or using the Site you agree to these Terms. If you do not agree, please do not use the Site. If you use the Site for an organization, you confirm that you have the authority to accept these Terms for it.

When you submit a form, the form shows its own notice and consent text. That text is separate from these Terms and does not change them.

3. Who the Site is for

The Site is written for organizations and professionals who examine mobile devices, and also for consultancies, labs and other service providers whose customers need device checks. The demo and quote forms are intended for organizations. The Site is not directed to anyone under 18.

SectraTEK is currently available to customers in the United States.

4. Using the Site

You may read the Site, download the documents we make available, and use the forms for their stated purpose. You agree that you will not:

  1. use the Site in a way that breaks the law, our Acceptable Use Policy or anyone's rights;
  2. send us evidence, case data, device extractions, or personal information about people under investigation through any form, email or other channel of the Site;
  3. give us false information, or pretend to be someone else or to act for an organization you do not represent;
  4. submit information about another person unless you have a lawful basis to do so;
  5. interfere with the Site or the systems behind it, probe them for weaknesses, or try to get around their protections (including the spam and abuse protections on forms);
  6. try to reach parts of the Site, My Sectra or our staff systems that are not open to you;
  7. copy the Site at scale with automated tools in a way that burdens it or ignores its published crawler rules;
  8. use the Site to send messages to other people, or to collect their contact details.

If you believe you have found a security problem with the Site, please follow our Vulnerability Disclosure Policy, which says how to report it and what you may test, or write to security@sectratek.com, and give us a reasonable time to fix it before you share it with anyone else.

5. Information on the Site is not an offer

The Site describes SectraTEK products and services. It is general information. It is not an offer that you can accept, and it does not create a contract. Prices, where shown, are in US dollars, exclude taxes, and apply only as stated in a written quote. Product descriptions, specifications and screenshots (which come from demonstration cases) may change without notice.

There is no online checkout, and no payment is taken on the Site. A purchase happens only through a written quote and a signed order form or purchase order, after our team has been in touch with you. Our team may verify your organization and its eligibility before we quote or sell, and we may decline a sale.

6. Software, licenses and orders

Purchases of SectraTEK software, hardware, subscriptions and support are governed by the SectraTEK license agreement and by the quote and order documents we issue, not by these Terms. If anything on the Site differs from your signed order documents, the order documents control. Using the Site does not give you a license to any SectraTEK software.

7. Demos, quotes, contact forms and downloads

Requesting a demo, a quote or a document, writing to us, or subscribing to the newsletter does not oblige either of us to enter into a contract. Our team uses the details you give us to respond, as described in the Privacy Policy. Please give us accurate information.

A link that we email you, for a download or to manage a demo, is for you only. It expires and can be used once, so please do not forward it.

8. Our content, our names and your submissions

The Site, including its text, graphics, video, design and software, is owned by Prudential Associates or its licensors and is protected by copyright and other laws. You may view the Site, and you may download and use the documents we provide for your own internal business use. You may not republish, sell, modify or distribute them, or remove any ownership notice.

SectraTEK and the SectraTEK logo are names and marks of Prudential Associates. You may not use them without our written permission. Other names on the Site belong to their owners.

If you send us ideas or suggestions about our products or the Site, we may use them without any obligation to you. This does not change how we handle your personal information, which is described in the Privacy Policy.

The Site links to other sites, for example our parent company's. We do not control those sites, we do not endorse them, and we are not responsible for them. How this Site itself uses cookies and similar technologies, and with whom, is described in the Cookie Statement and the Privacy Policy.

10. No professional advice; disclaimer

Threat briefs, articles, reports and other content on the Site are general information. They are not legal, forensic or other professional advice. We work to keep the content accurate and current, but it may be incomplete or out of date, and it does not promise any particular result from using SectraTEK.

To the fullest extent the law allows, the Site and its content are provided "as is" and "as available", and we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure, or that it will be without harmful components.

11. Limitation of liability

To the fullest extent the law allows, neither we nor our affiliates, licensors or service providers will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or business, arising out of or related to your use of the Site, even if we were told they were possible. Our total liability for all claims relating to the Site is limited to US$100.

Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or willful misconduct. Some places do not allow some of these limits, and in that case they apply only as far as the law permits. This section applies to the Site only. The liability terms of a purchase are in your license agreement and order documents.

12. Your responsibility

You are responsible for your use of the Site. To the extent the law allows, you agree to defend and indemnify us against claims by others that arise from your breach of these Terms or your unlawful use of the Site. This section does not apply to a government entity to the extent its law does not allow it (Section 13).

13. Government users

If you use the Site for a federal, state, local or tribal government entity, nothing in these Terms requires you to do anything that your law or your authority does not allow. In particular, any indemnity, any choice of law or court, and any other term in these Terms apply to you only to the extent your law permits. A claim by or against the United States is governed by United States federal law. A purchase by a government entity is governed by the license agreement and the quote and order documents.

14. Export control and sanctions

SectraTEK products and services are subject to United States export control and sanctions laws. You agree not to use, access, transfer or re-export anything you obtain from the Site in violation of those laws, and you may not use the Site if you are barred from doing so under them.

15. Governing law and disputes

These Terms, and any dispute or claim about the Site or these Terms, are governed by the laws of the State of Maryland, without regard to its conflict of laws rules. Any lawsuit about the Site or these Terms must be brought in the state or federal courts located in the State of Maryland, and you and we consent to the jurisdiction of those courts. These Terms do not require arbitration and do not waive any right to bring a claim in court. Section 13 applies to government users.

16. Changes to the Site and to these Terms

We may change the Site at any time. We may update these Terms from time to time. The version number and the date of the last update are shown at the top of this page, and an update takes effect when we post it. If you keep using the Site after an update, you accept the updated Terms.

17. General

These Terms, together with the policies they refer to, are the whole agreement about your use of the Site. They do not replace any license agreement or order document. If a part of these Terms cannot be enforced, the rest stays in force. If we do not enforce a part, that is not a waiver. We may assign these Terms in a sale or reorganization of our business, and you may not assign them without our written consent. You agree that we may send you notices about the Site by posting them on the Site, and you may send us notices at the address in Section 18.
